Welcome to Crowd (“Crowd”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of the Crowd mobile application, website, and related services (collectively, the “Service”).
By creating an account or using Crowd, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use Crowd.
By using the Service, you represent and warrant that:
You are legally permitted to use the Service
The information you provide is accurate
You will comply with these Terms and applicable laws
If you are under the age required by the laws of your country, you may use Crowd only with any required parental or legal guardian permission.
2. User Accounts
To use Crowd, you must create an account.
You are responsible for:
Maintaining the security of your account
All activity that occurs under your account
Keeping your login credentials confidential
You may not:
Impersonate another person
Use false or misleading identity information
Create accounts for abusive, fraudulent, or illegal purposes
Sell, transfer, or share your account without permission
We reserve the right to suspend, restrict, or terminate accounts at our discretion.
3. Social Features and Location Sharing
Crowd includes social, messaging, map, and event-related features.
Location sharing is optional and controlled by you. You understand and agree that:
Other users may see your shared location according to your privacy settings
Shared location information may reveal your real-world movements or presence
You are solely responsible for the audience you choose to share your location with
Crowd does not guarantee the accuracy, availability, or safety of any location-related information.
You should never use Crowd in ways that may endanger yourself or others.
4. User Content
You retain ownership of content you create or upload to Crowd, including:
Messages
Photos
Profile information
Event content
Other user-generated content
However, by using Crowd, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, display, reproduce, and distribute your content solely for the purpose of operating and improving the Service.
You are solely responsible for your content and interactions with other users.
5. Prohibited Conduct
You agree not to:
Harass, threaten, stalk, or abuse others
Share illegal, harmful, hateful, or sexually exploitative content
Use Crowd for unlawful activities
Attempt unauthorized access to systems or accounts
Scrape, crawl, reverse engineer, or interfere with the Service
Send spam, scams, or unsolicited commercial content
Share another person’s private information without consent
Use automated systems or bots without authorization
Circumvent blocks, bans, or restrictions
Misuse location-sharing features
We may remove content or restrict accounts at any time if we believe behavior violates these Terms or creates risk for users or the platform.
6. Moderation and Enforcement
Crowd reserves the right, but not the obligation, to:
Review reported content
Remove content
Restrict visibility
Suspend or terminate accounts
Cooperate with law enforcement where legally required
Moderation decisions may be made at our sole discretion.
7. Events and Meetups
Crowd may allow users to create events, gatherings, or social meetups.
Crowd is not responsible for:
User-organized events
User conduct at events
Real-world interactions between users
Injuries, damages, disputes, or losses arising from participation
Participation in events and meetups is entirely at your own risk.
Always use caution when interacting with people online or in person.
8. Messaging and Communications
Messages and communications on Crowd are stored and processed to provide core app functionality.
You understand that:
We may use automated systems to detect abuse, spam, fraud, or illegal activity
We are not responsible for user behavior or user-generated communications
We do not guarantee delivery, storage duration, or availability of messages
9. Privacy
Your use of Crowd is also governed by our Privacy Policy.
Please review the Privacy Policy carefully to understand how information is collected, used, and protected.
10. Third-Party Services
Crowd relies on third-party providers, including but not limited to:
Firebase
Apple Maps
Google Maps
We are not responsible for third-party services, systems, availability, policies, or actions.
Your use of third-party services may also be subject to their own terms and privacy policies.
11. Service Availability
We may modify, suspend, discontinue, or restrict any part of the Service at any time without notice.
We do not guarantee that:
The Service will always be available
The Service will be error-free
Data will never be lost
Features will always function correctly
12. Account Suspension and Termination
We may suspend or terminate your account immediately if:
You violate these Terms
We believe your behavior creates risk or liability
Required by law
Necessary to protect users, systems, or the platform
You may also delete your account at any time through the app.
Certain information may be retained where legally required or reasonably necessary for security, fraud prevention, or legal compliance.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROWD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY
RELIABILITY
AVAILABILITY
SECURITY
YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROWD AND ITS OWNERS, OPERATORS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:
INDIRECT DAMAGES
INCIDENTAL DAMAGES
CONSEQUENTIAL DAMAGES
LOSS OF DATA
LOSS OF PROFITS
PERSONAL INJURY
USER DISPUTES
USER CONDUCT
LOCATION SHARING CONSEQUENCES
EVENTS OR REAL-WORLD INTERACTIONS
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO CROWD, IF ANY, DURING THE PREVIOUS 12 MONTHS.
15. Indemnification
You agree to defend, indemnify, and hold harmless Crowd and its operators from any claims, liabilities, damages, losses, and expenses arising from:
Your use of the Service
Your content
Your interactions with other users
Your violation of these Terms
Your violation of any law or third-party rights
16. Changes to the Service or Terms
We may update these Terms from time to time.
Continued use of Crowd after changes become effective constitutes acceptance of the updated Terms.
The “Last updated” date will indicate the latest revision.
17. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws applicable in the jurisdiction where Crowd operates, without regard to conflict of law principles.
